The debate about reforming budget breaches is in full swing. A bill from the AfD, as of Bundestag published, calls for a new criminal law to combat budget breaches. It is about the introduction of a prison sentence of up to five years for public officials who grossly disregard budgetary regulations when spending public funds.

This initiative results from a gap in criminal liability that was viewed as scandalous and arose from a ruling by the Federal Court of Justice in 1997. At that time, the misappropriation of budget funds that were not included in the budget was viewed as breach of trust, but was restricted according to the so-called bow wave decision.
